Sell My Car Terms

These terms apply to the Sell My Car service. They supplement the General Terms of Service at carspot.ie/terms/general. Please also review our Cancellation Policy.
1. Service Description
CarSpot operates a private-seller auction marketplace (“Sell My Car”). Private sellers pay a listing fee (the current fee is shown at checkout) to submit a vehicle for dealer offers. The fee is processed via Stripe. Refunds and cancellation rights are described below and are subject to your statutory rights.
2. Auction Mechanics
Each listing runs for up to 7 days from submission, closing at a fixed daily time. Dealers submit confidential offers during this window. You may accept an offer and close your listing early at any time — you are not required to wait for the full listing period. When the auction closes (or you accept early), you receive the offer details by email and can contact your preferred dealer directly through the Platform.
3. Non-Binding Nature
All offers made by dealers are entirely non-binding. No contract of sale is formed through CarSpot. CarSpot is not a party to any subsequent transaction between seller and dealer.
4. Reserve Price
Sellers may set a minimum acceptable price (“reserve price”). This amount is not disclosed to dealers at any stage, including after the auction closes — it is for your own reference only, to help you decide which offer to accept. Once the auction closes, each bidding dealer is informed only of their own bid result (whether they were the highest offer or not). The seller's contact details are not shared with dealers unless and until the seller chooses to open a conversation with a specific dealer.
5. Listing Fee & Refunds
You are not charged the listing fee if no dealer submits a bid within 7 days. For card payments we place a temporary authorisation (hold) at checkout and only capture it once you receive your first offer; if none arrives, the hold is released and no charge is taken. For payment methods that must be charged upfront, the fee is refunded automatically instead. If one or more bids are received and the auction results are delivered to you, the fee is charged and is non-refundable unless we are required to provide a refund under applicable law. Any refund is issued within 5 to 10 business days to the original payment method; released authorisation holds typically clear within a few business days.
6. Right of Withdrawal
If you are a consumer, you may have a legal right to cancel this distance contract within 14 days without giving any reason, in accordance with the Consumer Rights Act 2022 and related Irish rules on distance and off-premises contracts. By submitting your vehicle and selecting immediate listing, you expressly request that CarSpot begins providing the Sell My Car service before the end of the 14-day cancellation period.
If you cancel after the service has begun, you may be required to pay for the proportion of the service already provided up to the time you notify us of cancellation. If the service has been fully performed before you cancel, and you previously acknowledged that you would lose your cancellation right once fully performed, you may lose your right to cancel. For this service, full performance occurs when the auction closes and the results are delivered to you.

7. Dealer Participation
Dealers receive listing notifications via our trade alert system. Participation is free of charge. Dealers have no obligation to bid on any listing. Dealer offers are non-binding and do not constitute a contractual commitment to purchase.
8. Data Sharing in Results
When an auction closes with one or more bids, the seller receives each bid amount, without any bidding dealer's identity being disclosed. Sellers must open a conversation with a specific dealer through the Platform to learn that dealer's name, dealership name, email address, and phone number and arrange next steps. Dealers consent to this disclosure, if and when it occurs, by participating in the platform. Sellers' contact details are not disclosed to dealers at any stage unless and until the seller opens a conversation with that dealer.
9. No Guarantee of Sale
CarSpot does not guarantee any minimum bid level, the accuracy of valuations, or that a sale will complete. CarSpot is not liable for any failure of a seller-dealer transaction to proceed.
10. Seller Warranties
By submitting a vehicle, you warrant that:
- You are the legal owner of the vehicle or have authority to sell it
- All information provided is accurate to the best of your knowledge
- All photos are genuine and unedited representations of the vehicle
11. Third-Party and Seller-Provided Information
Vehicle condition, history, mileage, and technical specification details shown on a listing are provided by the seller and/or sourced from third-party vehicle data providers. CarSpot does not inspect vehicles and does not independently verify the accuracy of this information. Dealers should verify any information that is material to their offer before completing a purchase.
12. Limitation of Liability and Indemnification
Section 9 (Limitation of Liability) of the General Terms of Service applies to your use of the Sell My Car service. As a private consumer using this service, your indemnification obligation under Section 10 of the General Terms is limited to losses arising from your breach of the Seller Warranties in Section 10 above, or from fraud or deliberate misrepresentation on your part. Nothing in this section affects any statutory rights you may have as a consumer under Irish or EU law.
